WHAT IS MEDIATION?
A private, confidential and co-operative process in
which an impartial person helps individuals or entities
to resolve conflict and settle differences.

HOW MEDIATION WORKS
All parties will meet together with the mediator in
joint and/or separate sessions.
The parties will share and then discuss all relevant
information and documentation.
The mediator will guide the parties through an
established yet flexible process to address the
differences between them.
The mediator will not impose or compel a settlement or
a particular result but rather empower the parties to
determine their own outcome.
If an agreement is reached, a written memorandum of
agreement is prepared and signed.

 

 

THE MEDIATOR’S ROLE
Encourage and facilitate discussion,
Assist with analysis and formulation of the contentious
issues,
Manage the process and guide the conversation,
Clarify with the parties what they need and what is in
their interest,
Work with the parties towards a mutually acceptable
and binding resolution.
Assist in the preparation of a written
memorandum/agreement, when appropriate.

THE ADVANTAGES OF MEDIATION
Mediation is practical, relatively informal, and
unencumbered by courtroom procedures or legal
technicalities.
In most cases, mediation is significantly faster and
less expensive than litigation.
Mediation empowers the parties to retain control of the
critical decisions that affect their personal, financial
and business interests.
Mediation enables the parties to fashion their own
solution rather than have one imposed upon them.
